Negligence To Go: Dunkin Donuts Coffee W/sugar

Diabetic claims coffee served with sugar sickened her Calls Dunkin Donuts negligent, claims coffee was a defective product Her conduct in ordering the coffee and ensuring the contents may be questioned Copy this link to share with friends: Negligence, Defective Product Alleged in Lawsuit The customers complaint includes two claims. To recover for negligence, she must prove Dunkin Donuts owed her a duty of care and negligently breached that duty, causing her harm. In this case she says it was negligence for the server to prepare the coffee out of her sight. Presumably this prevented her fromensuring the server used artificial sweetener and not sugar. If thats so, she could have asked the server to confirm artificial sweetener was added. Moreover, she could have mentioned she was diabetic and in need of special care. Ordinarily, mistakenly adding sugar instead of sweetener wont cause anyone harm. Maybe she should have ordered the coffee black and added sweetener herself. Possibly this was contributory or comparative negligence on her part. The customer also says the coffee served with sugar was a defective product. Sugar is not an unreasonably dangerous product, though it can kill a diabetic. So the customer will have to prove the coffee was defective, which for food, means unwholesome. It may be an important fact that she did, or did not, tell the server she was diabetic. Interestingly the customer did not include a warranty claim. If she ordered the coffee with sweetener, and it was sold to her with sugar, the coffee was not as warranted, and she could sue for her harm without proving it was defective. Can I Have Iced Coffee?

Can I Have Iced Coffee?

Yes black coffee itself has no carb, but by adding creamer/milk adds carb but is not too much, and yes you can sweetener. I enjoy a cup of coffee with a little bit of milk as part of my snack sometimes I have one everyday! I drink water all day and that is my only treat! I have mine w either less sweeter and regular milk or w a little soy milk and stevia I've always been ok with my numbers even if I have it w a meal :) enjoy! I use stivia and regular creamer- the sugar free is disgusting! But you only need like half a packet of stivia, it goes a long way. I have iced coffee with soy milk, order it unsweetened and just add in one packet of raw brown sugar myself. The one diet change that really stuck with me after having daughter with GD 3 years ago was cutting out sugar or any sweeteners from my coffee. I love a dunkin donuts iced coffee with cream no sugar. Mmmm might have to go for a d&d run now. Starbucks decaf iced coffee with sugar free vanilla made with heavy whipping cream instead of milk (less carbs) is soooo good Continue reading >>

Can I Ever Have A Donut Or A Malt

Can I Ever Have A Donut Or A Malt

I would really love to have a chocolate malt or a couple of dunkin donuts. Is there anyway I can have this without spiking my sugar? My glucose readings are in the normal range with help from my meds your sugars will spike no matter what you eat, the test is if they come back down in 2 hours to a normal range. I have a dunkin donut once in a while, it is included in my daily carb totals, also when I have it I am doing some sort of activity which provides a form of exercise which helps....but a couple of donuts I would not do, and if I had a chocolate malt I would make it a small Hey proverb, |I know that it sucks but why not try to find a replacement for those things. I know that when I get a donut craving I add it into my meal plan to substitute something like a donut hole. I have also looked around for other things that I could substitute for the donuts, some maybe smaller bites of something similar. I find that I can have one of the two bite brownies if I am really going through a sugar withdrawal but more and more lately, I tend to go more for the greek yogourt and mixing in some fresh fruit and nuts. I like the mouth feel of the greek yogourt and adding some fresh fruit to it really makes it yummy. Also, my friends who come over, I ask them not to bring over big honking desserts or chocolate bars because I find that too difficult. It is amazing how much they understand. Every once in a while, you will fall off the wagon, I think we all have, you just have to remember that your actions have repercussions. Just make falling off the wagon the exception rather than the rule. I used to love having a dessert after my dinners, now, I rarely have any dessert. Diabetes In Dunkin Donuts

Diabetes In Dunkin Donuts

Chris Stocker Diabetes Awareness , Diabetes Done Right , Diabetes Police About two years ago, I went into one of the Dunkin Donuts by my house and had a diabetes experience that sticks with me today. *Side note, I say one of the Dunkin Donuts because in south Florida you cannot trip and fall without landing in a DD. Anyway, when I went in there, my pump beeped so I pulled it out to hit the ACT button to get it to stop beeping. The cashier said, is that an insulin pump? I said, sure is. We began to have a short conversation while I was waiting for my bagel. Basically she told me that she was recently diagnosed with type 2 and that her doctor wants to put her on insulin, but she doesnt want to give herself shots because she was too afraid. I told her that she cant be afraid and just have to conquerher fears to save her life. Fast forward to today. I have gone to that DD 100 times in the years since thatoccurrencehappened, and I dont think she remembered me. Until we had another diabetes experience this morning. I started to take my insulin while I was in line, trying to do that 15 minutes before meal time stuff. Unfortunately, I got the annoying beep, not the doot-do-doo beep that goes off when you have a low reservoir, but the loud, obnoxious no delivery beep. So, I pulled the pump out to get the beeping to stop, and she noticed it again! What are the chances of that?!? Long story short, she has lost 20 pounds and doctor took her off insulin and she is now on a once a day pill and strict diet. She quit smoking and hasnt eaten fast food in over a year. You dont always get a lot of time to talk to cashiers at DD in the morning time, but when I do get a chance, this is what I love to hear. Wish I could say the same to her, except I was ordering a large iced coffee, sausage Continue reading >>

Dunkin Donuts Sued: Sugar In Diabetic's Coffee

Dunkin Donuts Sued: Sugar In Diabetic's Coffee

Dunkin Donuts Sued: Sugar in Diabetic's Coffee By Stephanie Rabiner, Esq. on June 7, 2011 5:46 AM Move over, McDonald's. There's a Dunkin' Donuts coffee lawsuit in town, and it has nothing to do with heat. Danielle Jordan of Philadelphia is suing the company for unspecified damages, claiming that after one of its employees served her sugar-laden coffee instead of the requested artificial sweetener, she went into diabetic shock. In June 2009, Danielle Jordan claims that she went into a Philadelphia Dunkin' Donuts and requested that they douse her coffee with artificial sweetener, as she suffers from diabetes, reports Reuters. While downing her drink, the Philadelphia Daily News reports that she became dizzy, light-headed and numb, necessitating a trip to the hospital. She had gone into diabetic shock . And so began the Dunkin' Donuts coffee lawsuit. Jordan blames the company, and believes that the incident was the result of a sugar mix-up. And now she wants money for what her lawyer calls "a loss of life's enjoyment." In tort actions, it's generally the duty of the plaintiff to demonstrate that the defendant is responsible by "a preponderance of the evidence." There are a lot of evidentiary problems that indicate that Danielle Jordan may not be able to do so. For one, did she keep the coffee for testing? And if she did, how will she prove that a tablespoon or two of sugar caused such a reaction and that it wasn't something she had eaten earlier in the day? She also fell ill while drinking the coffee, so had the sugar even been digested? Did she have her Diabetes under control? The questions go on and on, which doesn't bode well for Danielle Jordan and her Dunkin' Donuts coffee lawsuit. Continue reading >>

The Donuts And Diabetes Myth

The Donuts And Diabetes Myth

2 Amy Scheer November 26, 2012 at 9:57 am Youre rightit is a mythbut I have to agree with her. Were already bombarded regularly with candy given as rewards in school, donuts as birthday treats, that if someone could break the chain every once in a while, then those occasional treats can go back to being occasional. I have nothing against sweets, but I, too, was amazed when attending a JDRF open house and being offered chocolate cake, chocolate candies, and pop. Im not diabeticmy son isbut I rarely eat that stuff myself! And when I asked half-jokingly for a carb count, the JDRF worker said to me, HA! Good luck with that. I like your blog but I have to agree with that lady. I am always mortified when I see the crap food but out at a T1 event. Just because T1s CAN have foods loaded with sugar, doesnt mean they should. There are so many healthier choices to put out on a table! I have a 5 year old T1 who eats very healthy and we have amazing results because of it. When talking to other parents of T1s that eat nothing but junk and they cant seem to figure out why their numbers and A1Cs are completely out of wack.duh? Foods affect your body! The donuts & diabetes myth is not untrue just for T1. You can live on a steady diet of donuts & you will most likely eventually become overweight, but unless you have the genes for T2, you wont develop it. If you truly want to raise awareness about diabetes, you should provide correct info about ALL types. I have to agree with the others as far as teaching our kids to eat healthy. Theres nothing wrong with an occasional treat, carefully bolused for, however the constant diet of over-processed, chemical-laden, high fat & high carb diet so common in this country is not good for any child, let alone a child with diabetes. We can argue the di Continue reading >>

4 Foods To Steer Clear Of, And What To Have Instead

4 Foods To Steer Clear Of, And What To Have Instead

When you have diabetes, the list of foods to avoid can seem endless. Before you throw your hands up in despair, here are some healthy alternatives to foods you really should avoid when trying to manage blood glucose levels. 1. Coffee Drinks Flavored coffee drinks may seem harmless, but they can be loaded with hidden sugars. A large Frozen Coffee Coolatta®from Dunkin Donuts made with skim milk contains 410 calories and 101 grams of carbohydrates (98 grams coming from sugar!) And that’s the variety made with skim milk! If you reach for the large Frozen Coffee Coolatta made with cream, you will almost double the calorie content to 800 calories and the carbs to 97 grams per serving. These drinks provide the equivalent of 23 teaspoons of sugar. All of that added sugar spikes blood glucose levels, which is the last thing you want when you're dealing with diabetes. So what should you do if you are craving some flavor in your coffee, but don’t want all of the added calories and sugar? The smarter substitution: Try a coffee that has already been infused with flavor, such as hazelnut or French vanilla coffee with a splash of milk. A large French vanilla coffee from Dunkin Donuts (without any added cream or sugar) contains only 10 calories and 1 gram of carbohydrate. That’s a savings of 96 grams of carbohydrate or more! If you prefer to make your own, try sprinkling your coffee beans with a pinch of cinnamon, which not only helps to sweeten it up, but may help improve blood glucose regulation as well. 2. Prepackaged Fruit Smoothies Sure, they sound healthy. A smoothie blended with fresh fruit and vegetables—how could that ever be a bad thing? But pre-bottled smoothies, or ones you order from a local coffee bar or deli, often contain excessive amounts of added sugars. For Continue reading >>

9 Foods You Should Never Eat If You Have Diabetes

9 Foods You Should Never Eat If You Have Diabetes

For those who don’t have diabetes, nibbling a cookie here or some French fries there isn’t a big deal. Those unhealthy treats may run counter to your diet or weight-loss goals, but eating them isn’t the end of the world. For diabetics, on the other hand, one too many slip-ups could carry potentially life-threatening consequences. “It’s hard to say exactly what’s okay and what’s not because every patient with diabetes is a little different, and every patient’s tolerance for carbohydrates is different,” says Matthew Freeby, MD, director of the Gonda Diabetes Center at UCLA Health. “But if a patient eats enough carbohydrates that the pancreas is unable to produce insulin to drive blood sugar down, that’s what we worry about.” (Curb your sugar cravings and lose weight with the 3-week plan in Sugar Detox Made Easy!) As Freeby’s comment suggests, carbohydrates—a macronutrient group that includes sugar—pose the greatest threat to diabetics. Foods heavy in protein and fat, on the other hand, “tend to be the ones we have patients gravitate toward,” he explains. (Here are 6 signs of prediabetes you should know.) What exactly is Freeby worried about? Too-high or too-low blood sugar levels—known as hyperglycemia and hypoglycemia, respectively—can lead to symptoms like nausea, vomiting, stomach pain, a rapid heartbeat, dizziness, or confusion. In extreme cases, high or low blood sugar could lead to unconsciousness and death. If you’re diabetic and you experience any of the above symptoms (or a handful of others), it’s time to get your doctor on the phone—or head to the ER. Which foods are most likely to get diabetics into trouble? Keep reading. While there’s a small mountain of evidence linking diet soda to larger waistlines and other he Continue reading >>

8 Foods That Are Off-limits For Type 2 Diabetes

8 Foods That Are Off-limits For Type 2 Diabetes

Foods That Don't Belong in Your Diabetes Diet One of the most essential steps to avoiding complications from type 2 diabetes is managing your diet, says William Sullivan, MD, a senior physician at Joslin Diabetes Center and an assistant professor of medicine at Harvard Medical School. People with type 2 diabetes can control their blood sugar by eating foods that are low in sugar and carbohydrates. A healthy diet is even more important if you're overweight. "Weight loss has a dramatic effect on controlling diabetes," Dr. Sullivan says. He advises small portions and healthy foods — especially those low in sugar. So what shouldn't be on your plate? Avoid — or at least limit — these eight foods to help manage type 2 diabetes. Continue reading >>

What’s To Drink?

What’s To Drink?

Staying Hydrated in the Heat On a hot day, nothing quite hits the spot like a cold drink. But cold (and hot) beverages are not just enjoyable; they’re necessary for good health. Drinking adequate fluids in hot or cold weather keeps your body hydrated and running smoothly. When your body doesn’t have enough fluids, you can feel sluggish and irritable, get headaches, and have trouble controlling your blood glucose levels. You tend to need more fluids in hot weather because more are lost through sweat. Water is a good choice for staying hydrated because it has no calories, carbohydrate, fat, alcohol, or caffeine. Beverages that contain calories, carbohydrate, fat, or caffeine still provide needed fluids, but when drunk in large quantities, they can make weight control and blood glucose control more difficult. Alcohol has a diuretic effect, meaning it increases urine output, so beverages containing alcohol can promote dehydration. When you’re thirsty, having a drink containing alcohol is not a good choice; it’s better to drink nonalcoholic beverages first to quench your thirst before drinking any alcoholic drinks for pleasure. However, alcoholic beverages also contain calories, carbohydrate, and, less commonly, fat. While water is a good choice for health reasons, many people enjoy beverages with a little more flavor, such as fruit juices, soft drinks, tea, or coffee. There’s nothing inherently wrong with any of these beverages — and in fact, fruit juices, teas, and coffees contain beneficial antioxidants — but a high consumption of sweetened beverages has been identified as one of the reasons the United States is having an obesity epidemic. Part of the problem is that people tend to ignore the calories, carbohydrate, and fat in beverages. Studies suggest that Continue reading >>
