Medtronic is a publicly-listed medical technology development company and medical device manufacturer. Medtronic was founded in 1949 by Earl Bakken and his brother-in-law, Palmer Hermundslie, initially operating as a medical equipment repair shop. Medtronic has historically been a regular inclusion in the Fortune 500 list but was not included in the most recent publication, having moved its corporate headquarters out of the US to Ireland. Health insurer Humana filed a May 30 lawsuit against the device giant for providing misleading information about the bone graft, MassDevice reports. The lawsuit cites the Racketeer Influenced & Corrupt Organizations statute and was filed in Tennessee Western District Court. "Defendants paid for and sponsored publication of academic and peer-reviewed literature that falsely represented Infuse and [recombinant bone morphogenetic protein-2] as safe and effective for uses not approved by the Food & Drug Administration. Defendants knew or should have known that Humana would rely on the fraudulent literature to pay for Infuse and/or BMP," says the lawsuit, according to MassDevice. "Defendants also aided and facilitated hospitals and physicians in obtaining payments from Humana through false statements and fraudulent omissions and concealment to obtain insurance payouts where Infuse and/or BMP was used. Humana would not have paid for such claims had it known the true facts regarding the uses of Infuse and/or BMP or the risks and efficacy of such uses," the suit continues "Medtronic vigorously disagrees with any suggestion that the company improperly influenced peer-reviewed published manuscripts. But at the time Medtronic shut down its study, the FDAs public database of post-approval problems with medical devices contained just 261 reports about Infuse a quarter of the number of complications the company had gathered. Medtronic would eventually tell the FDA about more than 1,000 adverse events discovered through the study, more than five years after they were due. The FDA raised no issues about the late reporting and blacked out the total number of events from the three-sentence summary that became public. That number was revealed just months ago, after the Star Tribune challenged an FDA decision to keep it secret. Infuse Bone Graft is not a traditional medical device. Its key component is a vial of special powder that gets mixed with sterile water in the operating room. The bioactive solution contains a genetically engineered human protein known as BMP, or bone morphogenetic protein, that works like a drug inside the body to cause bone formation. In the 1990s, researchers realized that BMPs could transform common surgeries like spinal fusion. That procedure treats back pain caused by degenerative disc disease, but many patients require a second surgery to harvest living bone from the hip to graft vertebrae together. Lab-grown BMP offered the promise of bone graft without the time and pain of a second surgery.
