The two drugs are among the top-selling diabetes treatments in India. It was just another indication of how India's highest court is moving when it comes to Western drugmakers and their esteem for patents. Novartis this week lost what was seen as a landmark decision for an Indian patent on its cancer drug Glivec. But it is not alone in feeling the pain from India's penchant for putting its people ahead of patents. This latest move comes in the wake of the landmark decision by the Supreme Court of India to once again firmly reject Novartis' application to patent its cancer drug Glivec (imatinib). MSD Pharma launches JANUVIA for diabetic care NEW DELHI: Drug firm MSD Pharmaceuticals today launched its patent medicine under the brand name 'JANUVIA' in diabetic care segment and aims to tap four per cent market share in the domestic pharmaceutical segment by 2015. MSD Pharmaceutical is a wholly-owned subsidiary of US-based Merck & Co Inc. MSD is launching the drug JANUVIA, chemically known as 'Sitagiliptin', in sixty cities of the country simultaneously. "Globally, Merck has four per cent market share and we expect to achieve the same in India by 2015 through the launch of some of our best products in the country," company's Managing Director Dr Naveen Rao told reporters here. MSD which started its operations in the country three years ago, has set the target of capturing four per cent market share and it is also eyeing to emerge as one of top five domestic drug companies by 2015. The company, which globally launched its patented drug Sitagliptin in October 2006, has been able to record annual sales of around 700 million dollars. It is also planning to launch four more drugs used in therapeutic area of diabetes, dyslipidimia, cervical cancer and diarrhoea. "We are focused on bringing best medicines from the global portfolio of Merck to India," Rao said. Presently, MSD is waiting for the approval from Drug Controller General of India (DCGI) to launch more products in the country. "We have plans to launch one new medicine in a period of every six months for the next two-three years in the country," he added. However, the company declines to give details regarding the investments and about the sales revenue in the country. Merck filed a lawsuit against Glenmark alleging patent infringement in 2013, and the Delhi High Court rejected Merck's petition for an injunction in the same year. In May, the Supreme Court issued a temporary injunction on sales of Glenmark's products, which has now been made permanent. Glenmark had argued that it was using a different salt of sitagliptin in its products that sidestepped Merck's intellectual property, but that position was rejected by the court. It was also unswayed by Glenmark's argument that the lower price it was charging made the availability of its generics a matter of public interest. In India, Merck's MSD Pharmaceuticals subsidiary sells Januvia at 43 rupees a pill - around 20% of the drug's price in the US - compared to 14 rupees per pill for Zita. Nearly two years after Merck initiated an infringement action against Glenmark before the Delhi High Court over its patented diabetics drug sitagliptin (Indian Patent 209816, sold under the brand names Januvia and Janumet), in a May 15 2015 order the Supreme Court upheld the interim protection granted by the Division Bench of the Delhi High Court in favour of Merck, albeitin a limited manner. While restricting Glenmark from manufacturing and selling unfinished formulations of stagliptin phosphate monohydrate (SPM) (sold under the brand names Zita and Zitamet), the Supreme Court allowed Glenmark to sell existing stocks of its products, which are expected to meet market demand for five to six months. The Supreme Court also set a strict timeline for completion of the trial by June 30 2015 to ensure that highly contested commercial cases are disposed expeditiously, which is in the national interest. In April 2013 Merck approached the Delhi High Court seeking a permanent injunction against Glenmark for infringement of its patent for sitagliptin. On 5 April 2013, the Indian High Court of Delhi dismissed the application by MSD to prevent Indian firm Glenmark Pharmaceuticals (Glenmark) from manufacturing and marketing its anti-diabetes drugs Zita (sitagliptin) and Zita Met (metformin/sitagliptin). The court came to its decision based on the fact that the salt used in the drugs was not of a generic nature. MSD is suing Indias Glenmark for infringing its patent on two diabetes drugs.
